AFFIDAVIT

 

l/We, MD. NURU ISLAM Son/Wife of ABDUL MALEK address HOUSE NO-1050, WEST NANDI PARA, KHILGAON, BASABO, DHAKA do hereby affirm as under:

1. That l/We have deposited with Bangshal Branch of Social lslamic Bank Limited the Title Deeds relating to my/our property as detailed in the schedule hereunder with the intention of creating an equitable mortgage on the properties including all my/our rights, titles and interests comprised in or arising our of the said Title Deeds for sercuring to the said bank the payment on demand of the sum of Tk. 477,076.30(Tk) only invested/allowed by the said Bank to me/us or to M/s A TO Z with profit/rent of Tk. 477,076.30(Tk) only along with compensation social fund contribution if any payable to the said bank on the basis of the promissory not executed by me/us or the aforesaid party M/s A TO Z in favour of the Bank on.

2. That l/we am/are the absolut owner(s) of the said property/properties with full right to

mortgage and transfer my/our interest and no one else has any right title or interest in the said properties.

3.That l/we did not mortgage my/our property/ properties in question to any Bank/Financial Institution or elsewhere except Bangshal Branch of Social lslamic Bank Limited.

4. That the above scheduled property/properties shall be held by Bangshal Branch of  Social lslamic Bank Limited till fill liquidation of my/our liability or the liability of the party M/s. Social Islami Bank Ltd.

5. That the scheduled properties are free from encumbrance. If any defect or loophole in the Title is unearthed subsequently, I/We shall be liable to both criminal & civil actions by the bank.
